NCD Funding Opportunity: Evaluate the Impact of Section 503 Rehabilitation Act Amendments

The National Council on Disability (NCD) released a notice of funding for a cooperative agreement. Applicants are given the opportunity to propose methods for determining the impact of increasing employment opportunities for people with disabilities. The project seeks to examine the implementation and projected effectiveness of the amended Section 503 regulations that became effective in March 2014. Among other things, the resultant report is expected to develop recommendations for improving employee self-disclosure rates and discuss the Office of Federal Contract Compliance Programs’s role in improving contractor compliance. The award amount is $100,000 and proposals are due May 31, 2016.

September 2015 - Academic researchers from North Carolina A&T State University and Baruch College (CUNY) are working with RecruitMilitary to understand how individuals label their disability. This brief (3-5 minute) survey is a small part of a larger study that explores veteran's experiences in civilian employment after a military career.

Your completion of this survey and subsequent surveys will assist us in identifying areas of improvement for Veteran support organizations and employers.

Champions of Change: Disability Employment Champions Of Change

October 2014 – In recognition of National Disability Employment Awareness Month, the Obama Administration honored 10 Champions of Change recipients for their dedication to the employment of individuals with disabilities. Earlier this month in a Presidential Proclamation, President Obama pledged to combat employment discrimination and recognize those who demonstrate a commitment to diversity and accessibility in the American workforce. The areas of influence for each honoree are broad, ranging from entrepreneurship to workplace accessibility.

Among the Champions of Change honorees in the technology field, Microsoft Senior Director Jenny Lay-Flurrie is one of the leaders of the company’s Trusted Experiences Team (TExT). TExT focuses on accessibility, privacy, and online safety.

Another recipient is Tim Springer, Founder and CEO of SSB BART Group. SSB Bart Group has provided digital accessibility compliance solutions for industry, government, and educational institutions. Under Tim’s leadership, the company has taken a directive to ensure digital technology complies with regulatory standards, also empowering individuals with disabilities.

The U.S. Department of Health and Human Services (HHS) in collaboration with the U.S. Department of Labor (DOL) will host the 2014 A11Y Conference: Expect. Employ. Empower. This one-day conference will bring together the themes of technology, accessibility and employment of people with disabilities, and will focus on ensuring that accessible technology is available to all employees, including those with disabilities. Through exhibits and in-depth breakout sessions, federal and technology company innovators will present the latest information on improving accessibility in the workplace.

Settlement Agreement between the United States of America and The City Of Hubbard, Oregon

July 2014 – The Department of Justice has resolved its investigation of Hubbard, Oregon’s alleged violations of Title I of the Americans with Disabilities Act (ADA). The Settlement Agreement reads, “The United States alleges that the City has engaged in a pattern or practice of discrimination under the ADA by requiring applicants to disclose disabilities and/or medical information in their applications prior to making a conditional offer of employment.” The City of Hubbard has since withdrawn all disability-related questions from job applications and agreed to the following:

Not to conduct a medical examination or make a disability-related inquiry of a job applicant before a conditional offer of employment is made;
Not requiring a medical examination or making inquiries of an employee’s disability or the severity of the disability;
Confidentially maintaining the medical or disability-related information of applicants and employees in separate files; and
Training hiring personnel and employees on the requirements of the ADA, addressing and reporting ADA compliance.

Department of Labor Offers $15M in Grants for Employment of People with Disabilities

DOL $15M in Grant Funding

The U.S. Department of Labor (DOL) has made nearly $15 million available for state workforce agencies in an attempt to “develop flexible and innovative strategies to increase the participation of people with disabilities in existing career pathways programs in the public workforce system.” These grants are the fifth round of funds made available through the Disability Employment Initiative (DEI) from the DOL’s Employment and Training Administration and the Office of Disability Employment Policy. The DEI, which has awarded in the range of $81 million to service people with disabilities through public workforce systems, aims to award at least one grant for projects focusing on adults with disabilities (18 and up), projects focusing on youth with disabilities (14-24) and projects focusing on individuals 14 years and older with significant disabilities. Eight different grants will likely be awarded and will range from $1.5 to $2.5 million for a 42 month span. To apply, please visit http://www.grants.gov. EEOC Notice of Proposed Rulemaking

May 2014 – The U.S. Equal Employment Opportunity Commission (EEOC) is interested in revising the regulations implementing Section 501 of the Rehabilitation Act of 1973, which directly “governs employment of individuals with disabilities by the federal government.” The EEOC is looking to the public for input on how to improve federal hiring of people with disabilities. Under the current law, federal agencies are obligated to serve as model employers of people with disabilities, but there are no set rules they must follow by which to achieve this result. The EEOC hopes to remedy this through the provision of specific rules that address topics such as employment goals, workplace accommodations, and hiring, retention and advancement practices The Commission has issued an Advanced Notice of Proposed Rulemaking to gain public comment on the matter, requesting suggestions and/or comments. The deadline to submit responses is Monday, July 14, 2014 by 5pm EDT.

America at Risk: Job Crisis for People with Disabilities

April 2014 — RespectAbility has released a report entitled “America at Risk: Job Crisis for People with Disabilities – Views on Solutions from 3839 People on the Front Lines.” The report compiles data from a nationwide survey and focus groups of people with and without disabilities to highlight the current attitudes and practices regarding employment of people with disabilities. Findings from the report highlight that despite the disparity seen in the low employment of people with disabilities; approximately 71% of survey respondents noted the importance of employment and independence. A change was also seen in the attitude towards disabilities among younger people with disabilities, with 82% of respondents ages 18-29 reporting that “their disability gave them a challenge and that they are more capable because of it,” as compared to 69% of all respondents with disabilities. The report cites the largest barrier to employment of people with disabilities as the perceptions and attitudes of employers and suggests that additional training may be needed for employers. Of the report, Jennifer Laszlo Mizrahi, RespectAbilityUSA President, noted, “While the US Census and other reports measure many demographics of Americans with disabilities, RespectAbilityUSA’s report is unprecedented in its size and scope of asking people with disabilities and other stakeholders their own real-life experiences and opinions. People with disabilities need to be heard regarding the policies and practices that impact us the most.”

State of Science Conference

April 2014 — Presentations from the State of the Science Conference, sponsored by the University of New Hampshire, the Rehabilitation Research and Training Center for Evidence Based Practice in Vocational Rehabilitation (RRTC-EBP-VR) and the Kessler Foundation, are now available. Held April 8-9, 2014 in Bethesda, Maryland, the conference addressed employment disparities experienced by people with disabilities and presented research from three NIDRR-funded employment rehabilitation research and training centers. Included among the presentations was research from the Rehabilitation Research and Training Center on Employment Policy and Measurement, highlighting findings from a study evaluating the Youth Transition Demonstration projects, and the University of New Hampshire, describing cost effective workplace accommodations.
