June 2014 –Federal Communications Commission (FCC) Chairman, Tom Wheeler announced a tentative agenda for July’s Open Meeting. Reports to be considered by the Commission include: Modernizing E-Rate to Deliver Digital Learning, Connect America Fund Rural Broadband Experiments, and Closed Captioning of Internet Protocol-Delivered Video Clips. Regarding the latter, the FCC has planned a vote to determine if online video clips will be included in closed captioning mandates. The meeting is scheduled for Friday, July 11, 2014 at 10:30a.m. EDT.

December 2013 — In response to a decision by the Federal Communications Commission (FCC) to reconsider the exemption of IP delivered video clips from captioning rules, Senators Mark Pryor (D-Ark) and Edward J. Markey (D-Mass) wrote a letter to the FCC Chairman Tom Wheeler to express their support in reconsideration of the matter. As authors of the Twenty-First Century Communications and Video Accessibility Act of 2010 (CVAA), the Senators expressed that their original intent in drafting the legislation was to ensure that all video clips, regardless of length, include captioning when delivered via IP. In their letter, the Senators also highlight that the majority of current video clips do not include captions, “including 77% of news video clips.” The letter concludes by urging the FCC to reconsider the captioning rules noting, “We hope that the FCC takes this opportunity to resolve this issue and ensure millions of people who are deaf and hard of hearing are not shut out from important online programming.”

August 2013 — The FCC released an Order in the Matter of Closed Captioning of Internet Protocol-Delivered Video Programming: Implementation of the Twenty-First Century Communications and Video Accessibility Act of 2010 [MB Docket No. 11-154]. The Order extends the comment deadline for the Further Notice of Proposed Rulemaking released on June 14, 2013, wherein the FCC requested comments on requirements for the synchronization of closed captions and video display in addition to the closed caption requirements for DVD and Blu-Ray players that “do not render or pass through closed captions.” While the initial comment dates were set for September 3, 2013 for comments and September 30, 2013 for reply comments, the FCC has acquiesced to consumer groups’ request for a 60 day extension for comments with reply comments due 30 days thereafter. In their request, Telecommunications for the Deaf and Hard of Hearing and other consumer groups noted that additional time was needed to confer “on issues raised in the FNPRM” and “retain pro bono counsel to file comments and reply comments on their behalf.”

July 2013 — The Federal Communications Commission (FCC) released a Public Notice noting the deadlines concerning the June 14, 2013 Order on Reconsideration and Further Notice of Proposed Rulemaking (FNPRM) in the Matter of Closed Captioning of Internet Protocol-Delivered Video Programming: Implementation of the Twenty-First Century Communications and Video Accessibility Act of 2010 [MB Docket No. 11-154]. The Order on Reconsideration addresses petitions from stakeholders, concerning the rules for captioning of IP-delivered video programming for certain apparatus that will go into effect on August 1, 2013. For the FNPRM, where the FCC asked for comments on requirements for the synchronization of closed captions and video display in addition to the closed caption requirements for DVD and Blu-Ray players that do not render or pass through closed captions, initial comments are due September 2, 2013 and reply comments are due September 30, 2013.

06.13.2012 – The Consumer Electronics Association (CEA) Television Data Systems Subcommittee has formed a new working group to examine the effects of Internet-delivered closed captioning in relation to recent FCC regulations. In January of 2012, the FCC issued a Report and Order (R&O) implementing rules governing closed captioning for previously televised video programming delivered using Internet protocol (IP). The R&O, which became effective April 30, 2012, outlined requirements for owners, providers, and distributors of IP delivered video programming as well as manufacturers of devices used to display such content. The new CEA Television and Data Systems Subcommittee will specifically examine “receiver ramifications of Internet-delivered closed captions” including “decoder behavior recommendations, as well as studying the methods for signaling and transport of the captions in an MP4 file wrapper.” Those interested in joining the subcommittee or working group are asked to email Mark Levine. 03.15.12 – In compliance with Section 212 of the Small Business Regulatory Fairness Act of 1996, the FCC has issued a Small Entity Compliance Guide “intended to help small entities comply with new rules adopted” in the Report and Order concerning the implementation of Closed Captioning on Internet Protocol-Delivered Video Programming as related to the Twenty-First Century Communications and Video Accessibility Act of 2010 (CVAA) [MB Docket No. 11-154]. The guide outlines the requirements of video programming owners, distributors and providers and also highlights how small entities are affected by the R&O especially in terms of exemptions. Currently, the FCC allows small entity video programming distributors (VPD) and owners (VPO) to petition for a full or partial exemption from the requirements of Section 202(b) of the CVAA, which requires VPD and VPOs to implement internet protocol closed captioning, if the requirements are economically burdensome. In addition, small entities can petition for an exemption from Section 203, which delineates which devices must include capabilities for IP-delivered closed captioning, “if compliance is not achievable or technically feasible.” The guide states that the “exemption process will allow the Commission to address the impact of the rules on individual entities, including smaller entities, and to modify the application of the rules to accommodate individual circumstances.” [Source: FCC]
